The department administers California state laws which prohibit harassment and discrimination in employment, housing and public accommodations. Services include investigation of civil rights violation issues, employment discrimination assistance, housing discrimination assistance, and technical assistance in civil rights issues. There are no geographic restrictions.

The department accepts and investigates harassment and discrimination complaints; assists parties in complaints to voluntarily resolve disputes; pursues violations of the law to public hearing or court prosecution; and educates the public about the laws which prohibit harassment and discrimination. The department represents the state and does not advocate for either the complainant or the person against whom a complaint is made. Remedies for violations may include the job or housing denied to the complainant, back pay or promotion or compensation for moving and relocation, specific actions to prevent future discrimination, and compensatory damages including emotional distress damages and/or administrative fines.

Education about the law is provided through literature, public seminars and conferences. DISCRIMINATION IN EMPLOYMENT State law prohibits harrassment or discrimination in employment if it is based on race, ancestry, national origin, color, sex, religion, mental or physical disability (including AIDS), marital status, age (over 40), cancer or genetic characteristic medical condition, sexual orientation, refusal of family care leave, denial of pregnancy disability leave, retaliation for reporting patient abuse in tax-supported institutions.

The law prohibits discrimination in all employment practices including advertisements; applications and interviews; licensing or certification; referral by employment agencies; salary, classification and duties; hiring, transferring, promoting or leaving a job; working conditions; participation in a training or apprenticeship program, employee organization or union.

California workers are also:

- guaranteed leaves of absence if disabled because of pregnancy;

- guaranteed leaves of absence for the birth or adoption of a child or to care for a parent, spouse, or child who has a serious health condition;

- protected from harassment because of their sex, race, or any other category protected under the law; and

- protected from anybody retaliating against them for filing a complaint with this department, or for protesting possible violations of the law.

DISCRIMINATION IN HOUSING
State law prohibits discrimination in renting, leasing and selling housing if it is based on race, ancestry, sex, national origin, color, religion, sexual orientation, marital status, familial status or age, or mental or physical disability (including AIDS) and source of income.

Discimination is prohibited in all aspects of the housing business including advertisements; financial aid; sale and rental of housing; terms, conditions and privileges of occupancy, including freedom from harrassment; and restrictive zoning practices. As in employment discrimination law, persons are protected from retaliation for filing complaints.

DISCRIMINATION IN SERVICES AND ACCOMMODATIONS
Discrimination in public services and accommodations based on sex, race, color, religion, ancestry, national origin, disability, medical condition, marital status or sexual orientation is prohibited. These include hotels and motels, restaurants, theaters, hospitals, barber and beauty shops, and housing accommodations.
